1. ABOUT THESE TERMS

These Terms & Conditions apply to quotations, orders, supply, fabrication, delivery, templating and installation of stone worktops and related products supplied by Wells Granite & Marble Ltd (“Wells Granite”, “we”, “us” or “our”).

By accepting a quotation and/or paying the required deposit, the customer (“you” or “the customer”) agrees to these Terms & Conditions together with the specific details contained in the quotation.

Nothing in these Terms & Conditions removes, limits or excludes any statutory rights that a consumer may have under applicable Irish or EU consumer protection law.

2. QUOTATIONS
All quotations are prepared based on the information available to us at the time of quotation.

A quotation may be based on:

  • kitchen plans;
  • drawings;
  • measurements;
  • photographs;
  • information supplied by the customer;
  • information supplied by a kitchen company, builder or designer; or
  • information discussed with our staff.

Where Wells Granite is providing templating, the final dimensions and fabrication requirements will be confirmed during the templating process.

Unless specifically stated otherwise, a quotation includes only the goods and services expressly listed in the quotation.

Any additional work, materials, alterations or services requested after the quotation may incur additional charges.

All prices are stated in euro (€) and, where applicable, include VAT at the applicable rate.

3. ACCEPTANCE OF A QUOTATION

A quotation becomes an order when the customer confirms acceptance and pays the required deposit.

Payment of the deposit authorises Wells Granite to proceed with the agreed order, subject to the specific quotation and these Terms & Conditions.

Once an order has been accepted, materials may be ordered and production, templating and scheduling may be arranged.

Changes or cancellation after an order has been accepted may be subject to costs already incurred, subject always to the customer’s statutory rights.

4. DEPOSIT AND PAYMENT TERMS

4.1 50% Deposit

A 50% deposit of the total quoted price is required to confirm and book every order.

The order will not be considered confirmed, and production or fitting will not be scheduled, until the required deposit has been received and cleared.

The 50% deposit requirement applies to all customers without exception, unless Wells Granite & Marble Ltd has expressly agreed otherwise in writing before the order is accepted.

4.2 Remaining Balance

The remaining 50% balance must be paid in full before fitting/installation.

The balance must be received and cleared before our fitting team attends to carry out the installation.

Our fitting team will not commence installation where the balance has not been paid in full.

No payment arrangement, credit arrangement or extension of payment terms will apply unless specifically agreed in writing by Wells Granite & Marble Ltd before the fitting date.

4.3 Payment Methods

Wells Granite & Marble Ltd does not offer payment through Humm or other third-party “buy now, pay later”, finance or payment-plan services.

We do not accept Humm, Klarna, PayPal Pay in 3 or similar third-party finance arrangements unless such a service is expressly introduced and advertised by Wells Granite & Marble Ltd through our official website.

Customers should only use payment methods provided or approved directly by Wells Granite & Marble Ltd.

4.4 Bank Details and Official Payment Links

For deposits and balance payments, our scheduling or accounts team may provide:

  • Wells Granite & Marble Ltd bank account details; or
  • an official payment link issued on behalf of Wells Granite & Marble Ltd.

All customer payments must be made to Wells Granite & Marble Ltd.

Wells Granite & Marble Ltd does not operate separate businesses or trading names for receiving customer deposits or balance payments.

Customers should not make payments to:

  • individual employees;
  • fitters;
  • contractors;
  • personal bank accounts;
  • unrelated businesses; or
  • any other company or trading name

unless the payment has been expressly confirmed in writing by Wells Granite & Marble Ltd.

4.5 Protection Against Fraudulent Payment Requests

For your protection, if you receive a request to change bank details or to make a payment to a different account, individual or business name, please contact Wells Granite & Marble Ltd directly using the contact details published on our official website before making the payment.

Do not rely solely on an email requesting a change to payment details.

4.6 Proof of Payment

Where necessary, customers may be asked to provide proof of payment so that the payment can be correctly allocated to the relevant quotation or order.

A payment is considered received when the funds have cleared into the Wells Granite & Marble Ltd bank account or have been successfully processed through an official payment link provided by us.

4.7 Cancellation and Refunds

Payment of a deposit does not remove any statutory cancellation or consumer rights that may apply.

Where a customer cancels an order, the treatment of the deposit will depend on:

  • the circumstances of the cancellation;
  • the stage of the order;
  • materials already ordered;
  • materials already fabricated;
  • work already completed;
  • costs reasonably incurred; and
  • the customer’s statutory rights.

Where a refund is legally due, it will be processed in accordance with applicable law.

5. MATERIALS

Wells Granite & Marble Ltd supplies a range of materials including, where available:

  • granite;
  • quartz;
  • porcelain;
  • engineered stone; and
  • other stone and surface materials.

Each material has its own characteristics, care requirements, limitations and manufacturer’s warranty conditions.

Customers should ensure that they understand the characteristics of the material selected before placing an order.

6. NATURAL STONE VARIATION

Natural stone such as granite is a natural product.

Variations in:

  • colour;
  • shade;
  • veining;
  • pattern;
  • mineral deposits;
  • movement;
  • texture;
  • pits;
  • natural markings; and
  • other characteristics

are inherent features of natural stone.

A sample, photograph or showroom display cannot guarantee the exact appearance of the final slab.

Such natural variation does not automatically constitute a defect.

7. MANUFACTURED MATERIALS

Manufactured materials such as quartz and porcelain may also have variations between:

  • samples;
  • production batches;
  • slabs;
  • colours; and
  • finishes.

Digital photographs and screens may also display colours differently from the physical product.

8. SLAB AVAILABILITY

All materials are subject to availability from the relevant manufacturer or supplier.

If a selected material becomes unavailable, discontinued or unavailable in the required quantity or size, we will contact the customer to discuss available alternatives.

No substantially different material will be substituted without the customer’s agreement.

9. TEMPLATING AND MEASUREMENT

Where Wells Granite provides templating, final measurements are normally taken after the kitchen units have been installed and are ready for templating.

Before templating, the customer must ensure that:

  • kitchen units are fully installed;
  • cabinets are secure and reasonably level;
  • walls and relevant surfaces are ready;
  • appliances affecting the worktop dimensions are available or their exact specifications have been provided;
  • sink specifications have been provided;
  • hob specifications have been provided;
  • any special requirements have been communicated; and
  • suitable access to the property is available.

If the kitchen is not ready for templating, the appointment may need to be rearranged.

10. KITCHEN AND SITE CONDITIONS

Wells Granite is not responsible for correcting defects or problems with:

  • kitchen cabinets;
  • walls;
  • flooring;
  • plumbing;
  • electrical installations;
  • appliances;
  • building work; or
  • other work outside the agreed scope of our quotation.

The customer is responsible for ensuring that the kitchen is correctly installed and capable of supporting the worktops.

If unsuitable site conditions prevent safe or proper installation, we may delay the installation until the issue has been resolved.

Additional costs caused by site conditions outside our agreed scope may apply where permitted by law.

11. LEAD TIME AND FITTING

Our usual lead time from completed templating to fitting is generally 7–10 working days, subject to:

  • material availability;
  • fabrication requirements;
  • supplier availability;
  • workload;
  • access;
  • customer readiness; and
  • circumstances outside our reasonable control.

During particularly busy periods, holiday periods or periods of supplier disruption, lead times may be longer.

Where a specific fitting date has been confirmed in writing, we will make reasonable efforts to meet that date.

12. DELIVERY AND ACCESS

The customer must ensure suitable access to the property for delivery and installation.

The customer should inform us in advance about:

  • restricted access;
  • narrow roads;
  • stairs;
  • apartment access;
  • lifts;
  • gates;
  • parking restrictions;
  • difficult entrances; or
  • other access limitations.

If access is not suitable and installation cannot safely be carried out, the fitting may need to be rearranged.

Additional costs caused by unsuitable or undisclosed access conditions may apply where permitted by law.

13. EXISTING WORKTOPS

Unless specifically included in the quotation, Wells Granite & Marble Ltd does not remove or dispose of existing worktops.

Existing worktops should be removed before our templating appointment where required.

If removal has been specifically agreed, it will be stated in the quotation.

14. PLUMBING AND ELECTRICAL WORK

Wells Granite & Marble Ltd does not normally provide:

  • plumbing;
  • electrical work;
  • gas work;
  • appliance connection; or
  • other specialist services outside stone fabrication and installation.

The customer’s plumber or relevant qualified contractor is responsible for reconnecting services after installation.

Where a sink has been installed, the plumber should connect the sink and plumbing after the worktops have been fitted and sealed, allowing at least 24 hours for silicone/sealant to cure where applicable.

15. SINK AND HOB CUT-OUTS

Sink and hob cut-outs are included where specifically stated in the quotation.

The customer must provide accurate specifications for the sink and hob before fabrication.

The customer is responsible for ensuring that the selected appliances are suitable for the agreed cut-outs.

Changes to sink or hob specifications after fabrication has commenced may incur additional charges and may not always be possible.

16. RECESSED AND SPECIAL HOBS

Recessed, flush-mounted or specially profiled hobs may require additional fabrication.

Additional charges may apply and will be included in the quotation where known.

Any special fabrication requirements should be communicated before production.

17. JOINTS

Where a worktop requires one or more joints, the position will be determined by practical considerations including:

  • slab size;
  • worktop dimensions;
  • kitchen layout;
  • access;
  • material characteristics;
  • fabrication requirements; and
  • structural considerations.

We will make reasonable efforts to position joints appropriately.

A joint may remain visible to some degree and cannot always be made completely invisible.

18. UPSTANDS, SPLASHBACKS AND WINDOW SILLS

Upstands, splashbacks, window sills and other additional stonework are only included where specifically stated in the quotation.

Final dimensions may be confirmed during templating.

Existing walls and surfaces may not be perfectly straight, level or square. The finished stonework may therefore reflect the condition of the existing structure.

19. CARE AND MAINTENANCE

Customers must follow the manufacturer’s care and maintenance instructions for the material supplied.

Different materials have different characteristics.

Quartz

Quartz contains resin and is not heat-proof.

Hot pots, pans, trays or other hot cookware must not be placed directly onto quartz worktops. Suitable heat protection should always be used.

Granite

Granite is a natural stone and should be cleaned and maintained in accordance with the relevant manufacturer’s or supplier’s recommendations.

Porcelain

Porcelain is generally highly resistant to heat, staining and moisture. However, customers should still follow the manufacturer’s care and use instructions.

Failure to follow care instructions may affect a manufacturer’s warranty and may cause damage that is not covered.

20. DAMAGE AND MISUSE

Damage caused after installation may not be covered where it results from:

  • impact;
  • excessive force;
  • misuse;
  • unsuitable cleaning products;
  • excessive heat where applicable;
  • incorrect appliance installation;
  • plumbing or building work carried out by others;
  • failure to follow care instructions; or
  • other use outside the manufacturer’s recommendations.

This does not affect any statutory consumer rights.

21. MANUFACTURER WARRANTIES AND GUARANTEES

Some products supplied by Wells Granite & Marble Ltd are covered by manufacturer’s warranties or guarantees.

Depending on the product, a manufacturer warranty may provide coverage for an extended period, including 15 years for certain products.

The specific manufacturer’s warranty applicable to the product supplied will determine:

  • the warranty period;
  • what is covered;
  • exclusions;
  • registration requirements;
  • maintenance requirements; and
  • the manufacturer’s claims procedure.

Manufacturer warranties are separate from and additional to the customer’s statutory rights under Irish consumer law.

A manufacturer warranty does not remove or reduce any statutory rights available to a consumer.

22. WARRANTY CLAIMS

If a customer believes there is a product defect or warranty issue, they should contact Wells Granite & Marble Ltd as soon as reasonably possible.

We may request:

  • photographs;
  • videos;
  • proof of purchase;
  • quotation or invoice details;
  • product information;
  • installation information; and
  • access to inspect the work.

Where a manufacturer is responsible for assessing the warranty claim, Wells Granite may submit the relevant information to the manufacturer or its authorised representative.

The customer may be required to cooperate with reasonable inspection requirements.

23. REPAIRS AND CALLBACKS

Where a customer requests a visit, repair or callback that is not covered by:

  • a manufacturer’s warranty;
  • our agreed scope of work;
  • a statutory remedy; or
  • another obligation of Wells Granite,

a €200 callback/call-out charge may apply.

We will advise the customer of applicable charges before carrying out chargeable work where reasonably practicable.

No charge will be applied where doing so would be contrary to applicable consumer law.

24. CUSTOMER-PROVIDED INFORMATION

The customer is responsible for providing accurate information relating to:

  • kitchen dimensions;
  • sink model;
  • hob model;
  • appliance specifications;
  • tap holes;
  • drainage requirements;
  • upstands;
  • splashbacks;
  • window sills;
  • access; and
  • other special requirements.

Where inaccurate or incomplete information results in additional work, delays or fabrication changes, we will discuss the matter with the customer.

25. CHANGES TO AN ORDER

Requests to change an order should be made as early as possible.

Changes requested after:

  • templating;
  • material ordering;
  • fabrication; or
  • production

may not be possible.

Where changes are possible, they may result in:

  • additional material costs;
  • additional fabrication costs;
  • a new templating appointment;
  • delays; or
  • other reasonable additional costs.

Any additional costs will be explained before the additional work is carried out where reasonably practicable.

26. CANCELLATION

Cancellation rights depend on the circumstances in which the contract was entered into and the nature of the goods and services.

Nothing in these Terms & Conditions removes any statutory cancellation rights that apply to the customer.

For bespoke, made-to-measure or specially ordered products, cancellation rights may be affected by applicable consumer-law provisions once production or fabrication has commenced.

Where cancellation is legally permitted, Wells Granite may recover reasonable costs that it is legally entitled to recover, subject to the customer’s statutory rights.

28. CONSUMER RIGHTS

If you are a consumer, your statutory rights under Irish and applicable EU consumer protection legislation apply to your purchase.

Nothing in these Terms & Conditions excludes or limits those rights.

Where goods or services do not meet the legal requirements applicable to them, consumers may have legal remedies depending on the circumstances.

Manufacturer warranties and guarantees are additional to statutory consumer rights.

29. PHOTOGRAPHY OF COMPLETED WORK

Wells Granite & Marble Ltd may photograph or record completed installations, including:

  • kitchens;
  • worktops;
  • islands;
  • splashbacks;
  • upstands;
  • window sills;
  • cladding; and
  • other stonework supplied or installed by us.

By paying the booking deposit and proceeding with the order, the customer agrees that non-identifying photographs and videos of the completed work may be used by Wells Granite & Marble Ltd for marketing and promotional purposes.

This may include:

  • our website;
  • Instagram;
  • Facebook;
  • TikTok;
  • online advertising;
  • printed brochures;
  • showroom displays;
  • portfolios;
  • promotional material; and
  • other Wells Granite marketing channels.

We will not publish the customer’s name, address, telephone number, email address or other customer details together with the photographs.

We will take reasonable steps to avoid including:

  • people;
  • house numbers;
  • personal documents;
  • family photographs;
  • vehicle registration numbers; or
  • other identifiable personal information

in marketing photographs.

Photographs will normally focus on the completed work and the surrounding kitchen or interior required to properly display the installation.

Where a photograph or video contains identifiable personal information, it will be handled in accordance with our Privacy Policy and applicable data protection legislation.

Customers may contact us at [email protected] with concerns about a particular image or identifiable personal information.

30. WEBSITE AND PRODUCT IMAGES

We make reasonable efforts to ensure that information on our website is accurate and current.

However:

  • colours may appear differently on different screens;
  • photographs may not show the exact slab supplied;
  • product availability may change;
  • manufacturers may change product specifications; and
  • samples may differ from the final slab.

The specific quotation and agreed order details take precedence over general website information.

31. EVENTS OUTSIDE OUR REASONABLE CONTROL

We will not be responsible for delays caused by circumstances outside our reasonable control, including:

  • supplier delays;
  • material shortages;
  • transport problems;
  • severe weather;
  • fire;
  • flood;
  • power failure;
  • equipment failure;
  • industrial disputes;
  • government restrictions;
  • unforeseen site conditions; or
  • other circumstances which could not reasonably have been prevented.

Where reasonably possible, we will inform customers of significant delays and provide an updated estimated timeframe.

32. LIABILITY

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

In particular, nothing excludes or limits liability for matters that cannot legally be excluded or limited under Irish law.

Subject to applicable law, Wells Granite will not be responsible for damage caused by work carried out by third parties or for matters outside the agreed scope of our work.

33. PRIVACY

Wells Granite & Marble Ltd processes customer personal information in accordance with our Privacy Policy.

Personal information may be required for:

  • quotations;
  • orders;
  • payments;
  • measuring;
  • templating;
  • fitting;
  • delivery;
  • customer service;
  • warranty claims;
  • manufacturer warranty administration;
  • accounting;
  • legal obligations; and
  • marketing in accordance with our Privacy Policy.

Our Privacy Policy explains how personal information is collected, used, stored and shared.

34. DIRECT MARKETING

Where Wells Granite sends marketing communications by email, SMS or other electronic means, we will comply with applicable Irish data protection and electronic communications legislation.

Customers may unsubscribe from marketing communications at any time.

This does not affect the separate provisions relating to photographs of completed projects.

35. PAYMENT SECURITY WARNING

For your security, Wells Granite & Marble Ltd will only request payment using official payment details or payment links provided by our authorised scheduling/accounts team.

All deposits and balances must be paid to Wells Granite & Marble Ltd.

We do not use another business name or separate company to receive customer deposits or balance payments.

  • pay an individual;
  • pay another company; or
  • use a different payment method,

please contact Wells Granite & Marble Ltd directly using the telephone number or email address published on our official website before making any payment.
